Terms of Service

Important — please read. These Terms include a binding individual arbitration agreement and a class-action waiver in Section 20. They affect how disputes between you and us are resolved. You have a right to opt out of the arbitration agreement within 30 days of first accepting these Terms (see Section 20.7).

1. About these Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("you") and A Real Budget ("we", "us", or "the Service"). By creating an account, accessing, or using A Real Budget (including the website at https://arealbudget.com and any mobile or desktop applications), you agree to these Terms, our Privacy Policy, and our Data Retention Policy, which are incorporated by reference.

If you do not agree to these Terms, do not use the Service.

2. Eligibility, Age, and Sanctions

Age. You must be at least 18 years old and capable of forming a binding contract. The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we have collected information from a child under 13, we will delete it.

Sanctions & export.You represent that you are not located in, under the control of, or a resident of any country subject to U.S. embargo (currently Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), and that you are not on any U.S. government list of prohibited or restricted parties (including OFAC's Specially Designated Nationals list).

Permitted use. The Service is offered only where permitted by law and may not be available in every jurisdiction.

3. Your Account

Account security. You are responsible for safeguarding your credentials and for any activity under your account. Notify us immediately at support@arealbudget.com of any unauthorized access or suspected breach.

Accurate information. You agree to provide accurate, current information during sign-up and to keep it updated.

Authentication. We use Clerk, Inc. as our authentication sub-processor. Clerk handles your login credentials under its own terms; we do not see or store your password.

4. What the Service Does — and Does Not Do

A Real Budget is a personal cash-flow forecasting and budgeting tool. Its purpose is to help you plan, visualize, and reconcile your own financial activity.

The Service is informational only. It is not financial, investment, tax, legal, accounting, or fiduciary advice. Forecasts, categorizations, AI output, and any suggestions or summaries are automated estimates. They can be inaccurate, incomplete, stale, or materially wrong.

You are solely responsible for any decision you make — including, without limitation, decisions about spending, saving, investing, borrowing, lending, paying bills, managing debt, filing taxes, or taking any other financial action. Verify every figure against your bank, brokerage, or advisor before acting on it.

We do not hold, move, transmit, or custody funds. We do not execute trades. We do not extend credit. We are not a bank, broker-dealer, investment adviser, tax preparer, or money transmitter.

5. Connecting Financial Accounts (Plaid)

Bank and financial-institution connections are provided through Plaid Inc. When you link an account, you authorize us and Plaid to collect your account metadata, balances, transaction history, and related data from the connected institution on your behalf, and to use it to operate the Service for you.

By linking an account, you also consent to Plaid's End User Privacy Policy and confirm that the credentials you enter at your financial institution's secure login screen are yours or authorized for your use.

We never see or store your bank login credentials. You can disconnect any linked account at any time from within the Service.

Sync accuracy. Plaid-derived data can be delayed, missing, duplicated, or mis-categorized. We make no guarantee about the completeness, freshness, or correctness of data syncs.

6. AI-Generated Content

Some features use large-language-model providers (including OpenAI) to generate summaries, explanations, scenario analysis, and recommendations. These are probabilistic outputs. They can be wrong, biased, out-of-date, or misleading.

Do not treat AI output as financial, tax, investment, or legal advice. Do not rely on it to make decisions without independent verification.

We may use anonymized prompts and outputs to improve the Service. See the Privacy Policy for details on data sent to AI sub-processors.

7. Your Financial Data

Ownership. You retain all rights to the financial data you upload, sync, or enter.

License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and adapt your data solely as needed to operate and improve the Service for you, and as otherwise described in the Privacy Policy.

Export and deletion. You can download a full export of your data at any time from the Service and can delete your account from Settings. See the Data Retention Policy for timing details.

8. Acceptable Use

You agree not to:

  • Use the Service for unlawful, fraudulent, deceptive, or abusive purposes;
  • Access, probe, or attempt to access any account, data, system, or resource that is not yours;
  • Reverse-engineer, decompile, scrape, crawl, or systematically extract data from the Service beyond its intended UI and API;
  • Introduce viruses, worms, malware, or other harmful code; or otherwise interfere with the operation of the Service;
  • Submit personal information of third parties without their consent;
  • Use the Service to build, train, or benchmark a competing product;
  • Bypass or attempt to bypass rate limits, authentication, or other technical protections;
  • Use the Service in violation of any applicable law.

9. Fees, Subscriptions, and Billing

A Real Budget offers a free tier and an optional paid subscription called A Real Budget Premium. Premium pricing, subscription length, included features, renewal terms, and cancellation information are shown before purchase in the mobile app.

Auto-renewal. Paid subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the current period ends. You can cancel at any time; access continues through the end of the then-current paid period, and no prorated refund is owed except where required by law.

Mobile-store purchases.If you subscribe through the Apple App Store or Google Play, payment is charged to your Apple Account or Google Play account. Those purchases are governed by Apple's or Google's terms and billing rules. You can manage or cancel App Store subscriptions in your Apple Account settings. Refund requests for mobile-store purchases must be made through Apple or Google.

Taxes. Fees are exclusive of any applicable taxes, duties, or levies, which are your responsibility.

10. Electronic Communications and Records

By using the Service, you consent to receive communications from us electronically — including to the email address associated with your account — and to the use of electronic records and electronic signatures in our agreement. You may withdraw this consent by closing your account, but doing so will terminate your use of the Service.

11. Feedback

If you submit ideas, suggestions, feature requests, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback without attribution, compensation, or obligation. Feedback is not confidential.

12. Intellectual Property

The Service's software, design, text, graphics, trademarks, and branding are owned by A Real Budget or its licensors and are protected by intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service. No other rights are granted.

13. Third-Party Services and Sub-Processors

The Service relies on third-party providers including, without limitation, Plaid (banking data), Clerk (authentication), OpenAI (AI generation), Vercel (hosting), and Postgres database providers. Those providers process your data under their own terms and privacy practices.

We are not responsible for outages, errors, changes, or discontinuation of any third-party service. The Privacy Policy lists current sub-processors.

14. Mobile Applications (Apple and Google)

If you access the Service through our iOS application, the following additional terms apply and apply only to that use:

  • These Terms are between you and A Real Budget. Apple Inc. is not a party to these Terms and is not responsible for the application or its content.
  • Apple has no obligation to provide any maintenance or support for the application.
  • Apple is not responsible for any product warranties, whether express or implied. Any claim relating to the application's failure to conform to any warranty will be our responsibility, not Apple's, subject to the limitations in these Terms.
  • Apple is not responsible for addressing any claims by you or any third party relating to the application, including product liability, legal-compliance, or intellectual-property claims.
  • You must comply with any third-party terms of agreement that may affect your use of the application (e.g. your wireless data plan).
  • You represent that you are not located in a U.S.-embargoed country and are not on any U.S. government restricted-party list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

Equivalent terms apply to Google LLC for access through Google Play.

15. DMCA and Copyright

We respect intellectual-property rights. If you believe content on the Service infringes your copyright, please send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent at dmca@arealbudget.com.

We may terminate users who are repeat infringers in appropriate circumstances.

16. Termination

By you. You may stop using the Service at any time and delete your account from Settings.

By us. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, if required by law or a governmental request, if your account has been inactive for an extended period, or if we discontinue the Service.

Upon termination, the license granted to you under Section 12 ends immediately, and your data is handled as described in the Data Retention Policy. Before termination, you can export your data from Settings.

17. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, that any forecast, categorization, transaction sync, AI output, or other computation will be accurate or complete, or that defects will be corrected.

You use the Service at your own risk. Any financial decisions you make based on it are your sole responsibility.

18. Limitation of Liability

To the maximum extent permitted by law:

WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless A Real Budgetand its affiliates, officers, employees, agents, and licensors from and against any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to (i) your use of the Service, (ii) your violation of these Terms, (iii) your violation of any law or the rights of a third party, or (iv) content or data you submit. This obligation does not apply to the extent a claim is caused by our gross negligence or willful misconduct.

20. Dispute Resolution — Arbitration and Class-Action Waiver

Please read this Section carefully. It affects your legal rights, including the right to sue in court and to participate in a class action.

20.1 Informal resolution first. Before filing any formal dispute, you agree to send us a written notice describing the dispute to support@arealbudget.com. We will attempt to resolve it informally within 60 days of receipt.

20.2 Binding arbitration. Except as provided in Section 20.5, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including their formation, breach, or validity) will be resolved exclusively by final and binding individual arbitration, not in court.

20.3 Rules and forum. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will take place in the county of your residence, or remotely if the amount in dispute is under $25,000. The arbitrator may award any relief a court could award in an individual action and must issue a written decision.

20.4 Class-action waiver. You and we each agree to bring disputes only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, mass, or consolidated proceeding. The arbitrator may not consolidate the claims of multiple parties. If this class-action waiver is found unenforceable in a particular case, the remainder of this Section 20 will still apply.

20.5 Exceptions. The following disputes are not subject to arbitration:

  • Claims brought in small-claims court on an individual basis;
  • Claims seeking injunctive or equitable relief to stop unauthorized use or abuse of the Service or infringement of intellectual-property rights;
  • Disputes that cannot be arbitrated under applicable law.

20.6 Fees.If AAA's rules conflict with these Terms on who pays filing or arbitrator fees, AAA's rules control. We will pay the fees we are required to pay under AAA's rules.

20.7 Opt-out right. You can opt out of this arbitration agreement by sending written notice to support@arealbudget.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. The notice must include your full name, account email, and a clear statement that you want to opt out. Opting out does not affect any other part of these Terms.

20.8 Survival. This Section 20 survives termination of your account and these Terms.

21. Governing Law

These Terms and any dispute arising out of them are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, and, where applicable, by U.S. federal law. For any action not subject to arbitration under Section 20, you and we consent to exclusive jurisdiction and venue in the state and federal courts located in Delaware. Nothing in this Section removes any non-waivable consumer protection of your state of residence.

22. Changes to the Terms

We may update these Terms from time to time. If a change is material (for example, affecting your rights, fees, or how disputes are resolved), we will provide notice by email to the address on your account and/or by a prominent in-app notice at least 30 days before it takes effect, when reasonably feasible.

Continued use of the Service after the effective date of a change constitutes acceptance. If you do not agree to a change, stop using the Service and delete your account before the effective date.

23. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and Data Retention Policy, are the entire agreement between you and us regarding the Service and supersede any prior or contemporaneous agreements on that subject.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be reformed to the minimum extent necessary to make it enforceable.

No waiver. Our failure to enforce any right or provision is not a waiver of it.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.

Force majeure. We are not liable for any failure or delay caused by events outside our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, strikes, pandemics, utility or internet failures, or government actions.

Survival. Sections 4, 6, 7, 11, 12, 17, 18, 19, 20, 21, and 23 survive termination of these Terms.

No third-party beneficiaries. These Terms do not create any third-party-beneficiary rights, except that Apple Inc. and Google LLC are third-party beneficiaries of Section 14 with the right to enforce it against you.

Notices. Notices to you may be sent to the email address associated with your account or posted in the Service. Notices to us must be sent to support@arealbudget.com.

Headings. Section headings are for convenience only and have no legal effect.
